Vice President Li Shulan Attends the China–Europe Intellectual Property Judicial Forum

On September 18, Li Shulan, Vice President of the Shanghai Intellectual Property Court, attended the China–Europe Intellectual Property Judicial Forum in Suzhou. The forum was jointly organized by the Supreme People’s Court and the IP Key China Project, and hosted by the Suzhou Intermediate People’s Court of Jiangsu Province.

Xia Daohu, President of the Jiangsu High People’s Court, Wu Qingwen, Deputy Secretary of the Suzhou Municipal Party Committee and Mayor of Suzhou, He Zhonglin, Deputy Presiding Judge of the Intellectual Property Tribunal of the Supreme People’s Court, Klaus Grabinski, President of the Unified Patent Court, and Mimmochini, Intellectual Property Counselor of the Delegation of the European Union to China, attended the opening ceremony and delivered speeches.

Judicial officials and experts from China and Europe discussed hot issues in the field of intellectual property, including the calculation of damages in antitrust and patent cases, and the determination of patent infringement under the doctrine of equivalents. Vice President Li Shulan delivered a presentation on judicial practice in determining patent infringement under the doctrine of equivalents, addressing the basis, methods, and standards for applying the doctrine, the determination of equivalent infringement, and the limitations on its application. In response to questions raised by European judges on the application of the doctrine of equivalents in the chemical field, she engaged in in-depth discussions and responses based on specific cases.

Participants included representatives from the Third Civil Division, the International Cooperation Bureau, and the Intellectual Property Tribunal of the Supreme People’s Court; the Beijing, Guangzhou, and Hainan Free Trade Port Intellectual Property Courts; intellectual property tribunals from Nanjing, Suzhou, Wuxi, and Xuzhou; well-known experts and scholars; judges from the Civil and Intellectual Property Chambers of the District Court of The Hague, the French-language Commercial Court of Brussels, and the Patent and Market Court of the Stockholm District Court; officials from the IP Key China Project; and legal and customs officers from the Italian and Dutch embassies in China.
