On the afternoon of December 20, at the invitation of the Shanghai Association of Foreign Investment, the “Ling Song Judge Studio” of the Shanghai Intellectual Property Court delivered a lecture entitled “Judicial Protection of Intellectual Property and Risk Prevention for Enterprises” to representatives of foreign-invested enterprises in Shanghai.
More than 50 legal and intellectual property managers from over 20 foreign-invested enterprises, including Henkel (China) Investment Co., Ltd., Covestro (Shanghai) Investment Co., Ltd., and Toshiba Elevator (China) Co., Ltd., attended the lecture.
During the lecture, Judge Ling Song analyzed typical cases and summarized common issues identified by the Shanghai Intellectual Property Court in adjudicating disputes involving copyright, trademark, patent infringement, and unfair competition, particularly in the processes of intellectual property creation, protection, and management by enterprises, and offered corresponding suggestions. Judge Ling Song and members of the studio answered questions from enterprise representatives on topics such as generic names of goods, trade names, conflicts between code-scraping sales and trademark rights, the scope of copyright protection, and the determination of damages for infringement. Participants expressed that they benefited greatly from the session.
This lecture marked the first joint initiative by the Shanghai Intellectual Property Court and the Shanghai Association of Foreign Investment to promote a coordinated framework for intellectual property protection. Going forward, the court will further leverage its intellectual property adjudication function to serve and safeguard scientific and technological innovation, extend judicial services to various innovation-driven enterprises, and contribute to the development of Shanghai as a preferred international destination for intellectual property protection.
