The Delegation of American Intellectual Property Law Association Visited Shanghai Intellectual Property Court

On the afternoon of June 16, the delegation of American Intellectual Property Law Association (AIPLA), a total of 14 people, visited Shanghai Intellectual Property Court. AIPLA is a national attorney association consisting of attorneys handling personal and corporate business, lawyers serving the government, and law academics. The visitors this time are members of AIPLA China Committee. According to the arrangement of leaders of the Court, Presiding Judge of No.1 Intellectual Property Tribunal Liu Junhua, Judge Wu Yingzhe and Chen Yaoyao and Assistant Judge Tao Guandong received the delegation.

Presiding Judge Liu Junhua expressed his welcome to the AIPLA delegation, introduced the establishment background, organizational structure, staff composition and case trial of Shanghai Intellectual Property Court, and invited the delegation to watch an English feature about the work of the Court newly made by the Court.  Afterwards, centering on the issues that the delegation members were concerned about, Presiding Judge Liu Junhua introduced the operation of the Court, the role technological investigators played, application of injunction and source of the judges, etc., and answered the questions raised by the delegation members about the application of the Interpretation (II) of the Supreme People's Court on Several Issues Concerning the Application of Law in the Trial of Patent Infringement Dispute Cases.    Judge Wu Yingzhe introduced to the delegation the distribution of the burden of proof in the cases concerning know-how disputes and other issues.

Patrick J. Coyne, a board member of AIPLA, expressed his appreciation for the warm reception, introduction and exchanges provided by the Court. He said that the trial of cases, competence and work attitude of the judges of Shanghai Intellectual Property Court was impressive, and that as this visit deepened their understanding of the protection of intellectual property rights in Shanghai, he hoped to further strengthen communication with Shanghai Intellectual Property Court. After the communication, the delegation members, in the company of Presiding Judge Liu Junhua, visited the court building, litigation service center, case filing counters and courtrooms.
