On the afternoon of July 20, Mr. Danny Marti, Enforcement Coordinator of the U.S. Intellectual Property Enforcement Coordination Office and an accompanying officer Philippa Scarlett visited our court in the company of Mr. Michael Mangelson, U. S. Consulate General of Shanghai, and were received by Vive President Li Shulan. Mr. Liu Junhua, Presiding Judge of No. 1 Intellectual Property Tribunal, also attended the meeting.
Mr. Danny Marti is a U.S. Intellectual Property Enforcement Coordinator in the Executive Office of the US President, which is responsible for coordinating the affairs of American government's criminal, national security and economic departments in respect of intellectual property policies and law enforcement. In the company of Presiding Judge Liu Junhua, the delegation led by Mr. Danny Marti visited the case filing hall, litigation service center and court rooms, etc. of our court. In the following discussion and communication, Mr. Danny Marti and his delegation watched an English feature about the work of our court, and listened to the introduction of Vice President Li Shulan on the work of Shanghai Intellectual Property Court since its foundation. As introduced by Vice President Li Shulan, Shanghai Intellectual Property Court, as a special court founded in the context of a new round of judicial reforms in China, determined the "professional, international, authoritative and influential" development orientation since its foundation. To this end, Shanghai Intellectual Property Court took a series of effective measures of judicial protection in terms of improving trial efficiency, taking temporary judicial measures, increasing compensation, establishing technological facts ascertaining mechanism, multiplex intellectual property resolution mechanism and judicial publicity mechanism, preliminarily establishing a set of trial and working mechanisms conforming to the characteristics of intellectual property trials. In the future, Shanghai Intellectual Property Court would continue to make efforts in playing a dominant judicial role, strictly insisting judicial justice, deepening judicial reform, strengthening team building and enhancing judicial exchanges, in order to make Shanghai Intellectual Property Court the most favored court and the best choice for intellectual property cases in Asian-Pacific region.
Mr. Danny Marti expressed his appreciation for Shanghai Intellectual Property Court for the warm reception, and spoke highly of the efforts and achievements made in protecting the legal rights and interests of intellectual property right holders, fairly and effectively trying intellectual property cases and actively promoting judicial reform since its foundation. Mr. Danny Marti introduced the basis condition of the Office of the U.S. Intellectual Property Enforcement Coordinator, and expressed his wish to carry out further cooperation and communication with our court. Afterwards, both parties had further discussions on the challenges faced in trial of intellectual property cases, the management of trial term, determination of compensation amount, ascertaining of technological facts, and appointment and training of judges in the intellectual property court, etc.
Vice President Li Shulan thanked to the Office of the U.S. Intellectual Property Enforcement Coordinator for the concerns on and recognition of Shanghai Intellectual Property Court's work, and stated that as technology progresses and develops, the protection of intellectual property rights of the countries will face common technological and legal challenges. Through strengthening communication and cooperation on judicial protection of intellectual property rights, the countries can jointly facilitate the development and improvement of international rules on protection of intellectual property rights. Shanghai Intellectual Property Court is ready to communicate with peers in the judicial circle around the world to learn and draw lessons from each other, refer to the international advanced thought and general rules on judicial protection of intellectual property rights , and jointly raise the level of intellectual property right protection and healthy development of competition order.
