During
the period from Sept. 6 to Sept. 8, 2016, the 2nd International IP
Court Conference sponsored by Patent Court of Korea was held in Daejeon, South
Korea. The conference was themed “courts, intellectual property, and the
future”. More than 30 judges and scholars from the United States, Germany,
Britain, China, Singapore, Japan and South Korea attended the conference, visited
the Patent Court of Korea and electronic court, learned about its history and
judicial system, and had extensive interaction and discussion with each other
on the challenges and reform of intellectual property litigations, compensation
for damages, diversified dispute settlement mechanisms and the evidences of
patent litigations.
Liu
Jing and Yang Fuyu, judges of Shanghai Intellectual Property Court, attended the
conference at the invitation of Patent Court of Korea. They introduced in
English the operation of Shanghai Intellectual property Court, and its new
mechanisms and initiatives in IPR protection, and made respective introduction
to the non-litigation dispute resolution mechanisms in intellectual property
and related specialized organs, mediation procedures, rules of spoliation of
evidence, fact presumption and presumption of law in patent litigations and the
appraiser and expert assistant system in China, as well as the judicial
practice in patent infringement damages and the coordination of patent
administrative procedures and judicial processes, etc.
The
conference aimed to promote the coordination of intellectual property cases and
strengthen the exchanges and cooperation of intellectual property courts
worldwide. Shanghai Intellectual Property Court has been attaching great
importance to the international exchanges and cooperation in intellectual
property cases since its establishment. Attending the International IP Court Conference
not only allows the judges to learn valuable experience worldwide in the
juridical protection of intellectual property rights, but also contributes to manifesting
the achievements of China in this field and further improving the international
influence of Shanghai Intellectual Property Court.
