Recently, Shanghai Intellectual Property Court held the Judicial Committee Meeting, deliberated and passed the Operation Guideline for Judicial Expertizing of Technical Facts Involved in IPR-related Civil Procedures (hereinafter referred to as "the Operation Guideline"). It is an important initiative of Shanghai Intellectual Property Court on improving the "four-in-one" technical fact investigation and identification system, i.e. technical investigation, technical consulting, expert juror and technical appraisal. The Operation Guideline is conducive to standardizing the judicial expertizing works in IPR-related litigation, resolving the difficulties in finding technical facts in IPR-related cases, and plays a positive role in fair and effective trial of IPR-related cases. The Operation Guideline has totally 15 articles, mainly specifying the conditions and scope of judicial expertizing of technical facts; the procedural matters like the review of expertized items, selection of expertizing organization, submission of materials for expertizing, etc.; the duty of the court to inform the expertizing organization of its rights and obligations; the duty of collegiate bench to review the form of judicial export report, and its power to decide whether the judicial export report could be accepted as evidence. Meanwhile, the template of Power of Attorney for Expertizing is also attached to the Operation Guideline for the use of collegiate bench for entrusting a qualified expertizing organization during the trial of a case. Institutionally, the Operation Guideline would guarantee that technical expertizing could objectively, accurately and efficiently investigate the disputed technical facts in trial, and improve trial quality and efficiency.
