On December 16, the 2nd Intellectual Property Court Work Conference was held in Shanghai. Mr. Tao Kaiyuan, Vice President of the Supreme People's Court (SPC), addressed the conference. Mr. Cui Yadong, Secretary of the Party Leadership Group and President of Shanghai High People's Court, delivered a speech at the conference. Persons-in-charge of relevant departments including the Central Political and Legal Affairs Commission of the Communist Party of China, Legislative Affairs Commission of the Standing Committee of the National People's Congress and the State Intellectual Property Office of the P.R.C. (SIPO), experts and scholars from such research and teaching institutions as Chinese Academy of Social Sciences, East China University of Political Science and Law, Zhongnan University of Economics and Law and Dalian University of Technology, persons-in-charge of relevant department from SPC, leaders and tribunal directors from some high people's courts and intellectual property courts, and representatives of some specially invited advisors of SPC attended the conference.
Vice President Tao Kaiyuan pointed out that since their establishment two years ago, Beijing, Shanghai and Guangzhou Intellectual Property Courts have been actively promoting their respective construction, which therefore attracted widespread attention and received acclaim at home and abroad. It was also called for by Mr. Tao Kaiyuan that the three intellectual property courts firmly grasp the opportunities for development, further optimize the case jurisdiction layout, improve the trial mode of IPR cases of the first instance, improve the technical fact-ascertaining mechanism and court organization system, and carry out exploration to establish a mechanism for dynamic adjustment of judge quota based on the workload per capita as soon as possible, so as to give full play to the exemplary role of intellectual property courts and provide reproducible and promotable experience for the judicial reform. Meanwhile, it is necessary to conduct studies to implement a specific pilot programme for trial system reform of intellectual property courts in Beijing, Tianjin and Hebei initially, and make exploration to establish a national-level intellectual property appeal court from the perspective of national strategy. Vice President Tao Kaiyuan demanded that the intellectual property courts overcome the negative mentality of "Waiting" for things to happen, "Relying" on others to do the job and "Demanding" others to complete it, and by emancipating the mind, seeking truth from facts, creatively carrying out work, and planning the work based on the principles of a high starting point and high standards, build themselves into professional, modern and international first-class intellectual property courts in the spirit of "faster, higher, stronger".
President Cui Yadong said in his speech that the courts in Shanghai have always attached great importance to strengthening the judicial protection of intellectual property rights by establishing specialized judicial tribunals and actively promoting the innovations in intellectual property trial system and mechanism, and have trialed a number of intellectual property cases with domestic and even international influence. It was demanded by Mr. Cui Yadong that the courts in Shanghai must make full use of the historical opportunities to push forward the judicial reform, constantly sum up their experience, dare to carry out explorations to improve intellectual property trial system and mechanism, and give full play to the advantages of specialized courts in resources, systems and specialties to solve the system and mechanism problems that affect the judicial protection level of intellectual property rights, so as to further demonstrate the leading role of justice in intellectual property right protection and form reproducible and promotable experience.
The participants also made in-depth discussions on such topics as "Dynamic Adjustment Mechanism of Judge Quota and Trial Mode Reform", “Selection, Management and Use of Technical Investigation Officers", “How Intellectual Property Courts Implement 'Integrating Three Aspects into One'", “Cross-Regional Jurisdiction of Intellectual Property Courts - Take Beijing Intellectual Property Court's Jurisdiction over the Technical Cases in Beijing, Tianjin and Hebei for Example" and “Establishment of National Intellectual Property Appeal Court". President of Shanghai Intellectual Property Court Wang Qiuliang delivered a speech on the "Dynamic Adjustment Mechanism of Judge Quota and Trial Mode Reform", and Mao Ronghua, a member of the Party Leadership Group and Vice President of Shanghai High People's Court, delivered a speech on “How Intellectual Property Courts Implement 'Integrating Three Aspects into One'".
