On the afternoon of December 23,Shanghai Intellectual Property Court Workshop 2016 on Judicial Protection themed by "Improvementin the Judicial Protection Mechanism of IPR under the Leading ofJudicature–Establishment of a Diversified TechnicalFact Finding System" was held by Shanghai Law Society and Shanghai Intellectual Property Court jointly, which was presided over by Li Shulan, Vice President of Shanghai Intellectual Property Court, and attended by Lin Guoping, Executive Vice President of Shanghai Law Society, Wang Qiuliang, President of Shanghai Intellectual Property Court, Mao Ronghua,Vice President of Shanghai High People's Court, Shi Jixiong, full-time Vice President of Shanghai Law Society, the experts and scholars from Shanghai Jiao Tong University, Shanghai University and East China University of Political Science and Law, as well as representatives of judges and technical investigation officers from the three-tier courts in Shanghai. President Wang Qiuliang and Vice President Shi Jixiong delivered a speech respectively, and the participants expressed their views and put forward many useful suggestions on how to improve the diversified technical-factascertaining mechanismintegrating technical investigation, technical consultation, expert jury and technical appraisal into one, how to embody the leading role of judicature when ascertaining technical facts and how to utilize and give play to the role of various technical fact ascertaining methods more accurately, efficiently and systematically in trials.

President Wang Qiuliang said that ascertaining technical facts in an accurate and efficient way is relevant to the trial quality and efficiency of a case, which also has a profound influence on the technological innovationin an enterprise, an industry and even the whole society. Shanghai Intellectual Property Court will focus onthe building of system and mechanism to improve the accuracy, objectivity and efficiency in ascertainingtechnical facts fundamentally and make active response to the new demands andexpectations of all walks of life.

Vice President Mao Ronghua stressed that establishing a diversified technical fact finding mechanism is essential to trial practice, judicial reform and development of legal system. Since its establishment two years ago,Shanghai Intellectual Property Court has accumulatedreferable experience for establishment of a technical fact ascertaining mechanism, laying a good foundation for its further improvement. It was demanded by Mao Ronghuathat the court continue giving play to the leading role of judicature, standardize its fact-ascertaining procedures and improve the efficiency in ascertaining facts so as to further improve the diversified technical fact ascertaining mechanism.

Vice President Lin Guoping pointed out that Shanghai Law Society would continue paying close attention to thestudies in IPR protection field, give full play to its unique advantageofwide connections and gathering of professionals, strengthen itscooperation and exchange with all the courts in Shanghai including Shanghai Intellectual Property Court, and build and make good use of various platforms of its own, so as to contribute more to innovating the intellectual property trial mechanism, boosting the efficiency of IPR trials, strengthening internal construction and talent fostering for IPR trials, and therefore improving the authoritativeness, credibility and influence of the trial of intellectual property right cases in Shanghai.
