Shanghai No. 3 Intermediate People's Court (Shanghai Intellectual Property Court) Made Achievements in Producing Fine Works by Four Initiatives   One Intellectual Property Case Was Published on the Gazette of the Supreme People's Court

Recently, Beijing iQiyi Technology Co., Ltd v. Network Video Clustering Technology (Shenzhen) Co., Ltd unfair competition case heard by Shanghai Intellectual Property Court was published on the Gazette of the Supreme People's Court (Issue 12 - 2016), becoming the first case published on the Gazette since its establishment. Over the past two years, Shanghai No. 3 Intermediate People's Court (Shanghai Intellectual Property Court) has been committed to producing fine works and achieved good results with the aim to enhance its credibility and influence. 12 cases were published on the Gazette of the Supreme People's Court or rated as 2015 Top 50 Typical Intellectual Property Cases in Chinese Courts, Top 10 Civil and Administrative Cases Trialed by People's Courts in 2016, Top 10 Cases concerning Judicial Protection of Intellectual Property Rights by Shanghai People's Courts in 2015 and Top 10 Cases concerning Copyright Protection in Shanghai respectively. Initiatives:

First, improve the work mechanism. Shanghai No. 3 Intermediate People's Court (Shanghai Intellectual Property Court)has issued Measures for the Administration of High-Quality Cases and Opinions on Deepening the Production of High-Quality Cases, established and improved a source discovery mechanism, meticulous trial mechanism and investigation & publicity mechanism for high-quality cases to ensure their whole-process management from discovery, ascertainment, nurturing to, trial, reporting,selection and incentives, so as to guarantee the production of high-quality cases. 

Second, strengthen the main body responsibility. Define the responsibilities of various trial departments, strengthen the self-consciousness of judges in discovering and hearing high-quality cases, give play to the role of investigation correspondents in trials, organize reporting and writing timely and constantly deepen the interconnection between our court with Shanghai High People's Court and communication between our departments to give full play to our organizational advantages in case work.

Third, organize the appraisal and selection carefully. Trial Administration Office (research office) shall play an active role in organizing and coordinating to strengthenthe communications between various departments and with superior courts, organize case study, appraisal and recommendation carefully to bring more high-quality cases recognized by superior courts.

Fourth, expand the effect of high-quality cases. On the basis of mastering the outstanding cases of the court, incorporate those of typical significance and reference value in the Trial Study and publish high-quality cases on journals like Shanghai Trial Practice, People's Judicature, People's Court Daily and China Intellectual Property News, and websites, WeChat and Weibo, etc to further expand the effect of high-quality cases, thereby establishing the authority of the judiciary and winning public trust.
