On the morning of March 27,Shanghai No. 3 Intermediate People's Court (Shanghai Intellectual Property Court, Shanghai Railway Transportation Intermediate Court) held a  president's work meeting to listen to the spirits of 2017 Work Conference of Shanghai Courts on IPR Trials and implementation opinions. It's required that all tribunals of Shanghai Intellectual Property Court shall carry out the spirits and opinions carefully according to the conference deployment and specific requirements of Shanghai High People's Court.

I. Perform our functions, persist in taking law enforcement and case handling as the top priority, and further enhance judicial credibility. First, we should step up our study to deeply carry out the spirits of the work conference of Shanghai courts on IPR trials and further align our thinking and actions with the requirements on IPR trials of Shanghai courts. Second, define our goals, do a good job in law enforcement and case handling, and rationally allocate judicial power and resources to ensure efficient completion ofjudicial tasks throughout the year. Third, fully understand the judicial policies of "judicial leadership, strict protection, type-based tactics and harmonious proportion", give play to judicature's dominant role and make breakthroughs in strengthening IPR protection and increasing IPR infringement compensation. Fourth, highlight priorities. Establish and improve high-quality case production and management mechanism to strive to produce influential high-quality cases, thereby enhancing the authoritativeness and credibility of Shanghai Intellectual Property Court in IPR trials.

II. Deepen the reform and explore to improve specialized IPR trial system to further enhance trial quality and efficiency. First, further explore and put into practice the application of "four in one" technical fact-finding system (technical investigation, technical consultation, expert assessor and technical appraisal) in trials of technical intellectual property cases, and study and lay down the rules on court appearance of technical investigators. Second, actively explore and summarize the trial rules of similar cases, and standardize the trial ideas to promote judicial unity. Third, explore appropriate format of judgment documents in line with the trial rules, and give full play to the functions of pretrial meetings to improve trial efficiency.

III. Raise our awareness, actively carry out the opinions and initiatives to serve the national strategy and overall interests of Shanghai Municipality, and further raise the development level of the service sector. First, continue to carry out 26 opinions and 20 initiatives to serve the construction of Shanghai Technology Innovation Center as well as 12 opinions to serve the construction of Shanghai International Trade Center, strengthen the trials of cases related to science and technology, free trade zone and international trades and summarize the trial rules and methods to improve trial efficiency. Second, deepen our cooperation with the Management Committee of Zhangjiang High-tech Industrial Development Zone and expand the scope and depth of Office of Judge Chen Huizhen, National Adjudication Expert. Third, explore and establish special preservation and enforcement channels for IPR cases involving Zhangjiang High-tech Industrial Development Zone and FTZ, form an internal working mechanism to improve the preservation and enforcement quality and efficiency in a scientific way. Fourth, seriously carry out webcast of court trial, judicial suggestions, Open to Public Day and other events, actively hold 4·26 IPR protection publicity month activities and release white paper on IPR trials and typical cases at due time to expand and intensify judicial extension.

IV. Strengthen personnel training, seriously carry out the measures to improve team quality and further enhance professional competence. First, continue todo a good job in ideological and political education and construction of the Party conduct and of an honest and clean government, enhance the police's consciousness of the need to uphold political integrity, keep in mind the bigger picture, follow the CPC as the core of the Chinese leadership and act consistently with CPC Central Committee policy, exercise strict self-discipline and self-management, and do a good job in IPR trials under the new context with high sense of responsibility and mission. Second, strengthen the study of difficult and complex problems in judicial practice, carry out special researches on  difficult problems during the trials of patent cases, franchising contract cases, etc. and evidence rules for IPR cases to further enhance theprofessional competence of the judicial team. Third, explore and study dynamic deployment mechanism of judges and  rotating employment and exchange mechanism of judge assistants, strengthen the training of key trial staff and eminent judges, give full play to the role of learning and communication platforms "Sanwei School House" and "Sanwei Lecture Room", arouse the work enthusiasm of young police officers and improve the work quality. Fourth, insist on being strict and caring, and organize various cultural events and sports to create a a healthy working environment for all court officers.
