As support personnel in Shanghai Intellectual Property Court, technical investigators are playing an active role in assisting judges in ascertaining technical facts. In order to further improve thetechnical investigatorsystem, regulate the participation of technical investigators in court proceedingsaccording to law, and find technical facts in intellectual property cases more objectively, accurately and efficiently, Shanghai Intellectual Property Court formulated the Rules of Shanghai Intellectual Property Court on Participation of Technical Investigators in Court Proceedings (for Trial Implementation) after full investigations in combination with the actual situation, which contains 16 articles. As one of the priorities of Shanghai Intellectual Property Court this year, these rules were formulated with the aim to make the technical investigator system more standardized and perfect, for which Technical Investigation Division had done a lot of investigations and listened to the opinions of technical investigators and trial business tribunals. These rules detailed the withdrawal procedures, dress code and coordination of technical investigators with expert jurors, stipulated how they ask the parties concerned about technical facts in dispute, matters they should pay attention to, how they participate in mediations, make comments and issue technical examination opinions, as well as the confidentiality requirements they should comply with. They not only summarized the regulations on participation of technical investigators in court proceedings, but also made a good exploration to further deepen the technical investigator system.
