Technology Experts Made Inquests in Court A Patent Infringement Case Was Concluded Successfully

Recently, a cases involving utility model patent infringement was heard by Shanghai Intellectual Property Court in public. During the court session, technology experts were invited to inquest the parties, dismantle the product involved and issue opinions on the structure of whole product,position and function of each component and the connections betweenvarious components, whereas the parties should make cross examinations. Finally, the collegial panel rendered its verdict after deliberation in combination with the results of pre-trial meeting and court hearing. Technology experts’ participation in court trial and inquest is beneficial in that i) it improves the transparency of court trials and ensures full disclosure of technical fact-finding processes, addressing the party's doubts and allowing them to see the decision-making process of the court more intuitively; ii) it enhances the professionalism of court trials. Technology experts can help the judge to find out the dispute between the parties, highlight the focus and clarify the technical facts as soon as possible, thereby laying a good factual basis for judges to make verdicts; iii) it improves the efficiency of court trials. Unlike time-consuming technical appraisal, inviting technology experts to dismantle the product, inquest the parties and issue opinions in court while asking the parties to make cross-examinations allows inquests and cross examinations to be carried out concurrently and technical facts to be ascertained in court session, thereby improving the trial efficiency greatly.
