Opening Ceremony Held for the “Scientific Innovation Research (Shanghai) Base for Judicial Guarantee of Intellectual Property of the Supreme People’s Court”

On the afternoon of September 15, an opening ceremony of the “Scientific Innovation Research (Shanghai) Base for Judicial Guarantee of Intellectual Property of the Supreme People’s Court” was held at Shanghai Intellectual Property Court (SIPC) by the Supreme People’s Court (SPC). A seminar for work investigation of scientific innovation for judicial guarantee of intellectual property was also held. Mr. Tao Kaiyuan, Vice President of the Supreme People’ Court (SPC), and Mr. Cui Yadong, Secretary of the Party Leadership Group and President of Shanghai High People’s Court (SHPC), jointly unveiled the plaque of the Research Base and delivered a speech respectively.Mr. Song Xiaoming, Director of the IP Tribunal of SPC, read out the Official Reply of the Supreme People’s Court of Approving the Establishment of a Scientific Innovation Research (Shanghai) Base for Judicial Guarantee of Intellectual Property of the Supreme People’s Court at Shanghai Intellectual Property Court. Mr. Wang Qiuliang, President of SIPC, presided over the opening ceremony and reported the main practices and achievements of SIPC in serving and guaranteeing scientific innovation. Mr. Mao Ronghua, member of the Party Leadership Group and Vice President of Shanghai High People’s Court (SHPC), presided over the investigation seminar.
As was pointed out by President Cui Yadong, SPC’s decision to establish the “Scientific Innovation Research (Shanghai) Base for Judicial Guarantee of Intellectual Property of the Supreme People’s Court” in Shanghai not only reflects its trust of SIPC, but also endows the latter brand new missions. SHPC will spare no effort in serving and guaranteeing the construction and development of the Base. It will also continue to deepen the reform of IP courts, make innovations in the IP trial system and mechanism, and keep promoting the modernization process of the IP judicial system and judicial capability.
Vice President Tao Kaiyuan pointed out that to establish the Scientific Innovation Research (Shanghai) Base for Judicial Guarantee of Intellectual Property of the Supreme People’s Court is not only an important move of the people’s courts to serve and guarantee the major work tasks of the CPC and the state, but also an act that fully reflects the achievements made in the reform and development of IP courts. He proposed three points of his expectations of the research base construction. First, the Base should function as a bridge for information exchange in a real sense. With the support from SIPC, it is supposed to promptly report to SPC the new conditions and new problems that it encounters in scientific innovation for judicial guarantee of intellectual property, so that SPC might learn about, in a timely manner and from a general perspective, the practical demands of scientific innovation on the judicial protection of intellectual property. Second, it should function as a window for judicial guarantee. It is essential to analyze and release research reports on a regular basis by closely centering around the theme of scientific innovation for judicial guarantee of intellectual property, in order for the Research Base to become an important window for the people’s courts to serve and guarantee scientific innovation and perform their functions, and also an important window for people both at home and abroad and from all walks of life to learn about the role of judicial protection of IP rights. Third, it should play the role as a think tank for capacity increase.The Research Base shall closely focus on the new conditions and new problems found in the process of serving and guaranteeing scientific innovation and hold, when necessary, seminars to bring to play the talent gathering function of the Research Base and form a highland for talent pools. Timely summary shall be made for those experiences and practices of scientific innovation on the judicial protection of intellectual property, to provide more replicable and promotable institutional experiences for the strategy of innovation-driven development supported by IP trials.
