Shanghai Intellectual Property Court set up a special trial team to serve and guarantee China International Import Expo

On August 24, Shanghai Intellectual Property Court issued the Opinions on the Establishment of A Special Trial Team to Serve and Guarantee China International Import Expo, in which it states that a special trial team is established to deal with the intellectual property cases, thecriminal, civil, commercial and administrative cases concerning the Import Expo. This is a concrete measure taken by Shanghai Intellectual Property Court to give full play to its judicial function to serve and guarantee the Import Expo. It is conducive to exerting the effect of intensive trial, improving the quality and efficiency of trial and providing fair and efficient judicial services and guarantees for the smooth preparation, successful holding and sustainable development of the Import Expo. The Opinions consist of 15 articles, covering the following four aspects: first, clarify the organizational structure of trial. The Import Expo-related cases shall be tried by special collegial panels or appointed special persons. Major, difficult, complex or new types of cases shall be presided over by the President of the court, members of the Trial Committee or the President of the tribunal. Second, establish an effective hearing mechanism. The court should strengthen the connection betweenfiling, trial and enforcement, implement the working mechanism featuring fast filing, fast preservation, fast mediation and priority ofenforcement,use the Internet to conduct trial, improve the efficiency of trial and meet the needs of efficient trial of Import Expo-related cases. Third,conduct special trial management. The court should adopt the practice of reporting on each major case, improve the analysis and judgment of the situation through the big data platform, work on high-quality trial and provide guidance on typical cases, enhance the discussion and solution of difficult problems in the Import Expo-related cases, and promote the applicability of relevant laws. Fourth, strengthen the extension of the court’s judicial function. The court should closely coordinate with relevant functional departments to make joint efforts, provide judicial guidance and suggestions for market activities and administrative enforcement by making judicial proposals and issuing the white paper on trial, and effectively prevent legal risks; also, it should strengthen the measures taken to hand Import Expo-related cases and the publicity of effectiveness, so as to create good environment of public opinion.
