On September 25th, Shanghai Intellectual Property Court held a meeting on intellectual property trial work. All members of the special trial teams for cases concerning the free trade zone and the CIIE attended the meeting. Vice President Li Shulan attended the meeting and put forward specific requirements on the fulfillment of special trial work. The meeting was presided over by Ms. Chen Huizhen, a full-time member of the trial committee. Ms. Chen Huizhen summarized the various tasks carried out since the establishment of the special trial team for cases concerning the free trade zone, introduced the adjustment of the special trial team for the free trade zone and the formation of the special trial team for the CIIE. Members of the two special trial teams put forward specific opinions and suggestions on carrying out special trial work. Vice President Li Shulan pointed out that the establishment of the special trial teams for the free trade zone and the CIIE to focus on the intellectual property cases involving the free trade zone and the CIIE is an important move of our court for serving the development of the free trade zone and the holding of the CIIE. With respect to carrying out the two special trial work, Vice President Li Shulan put forward five requirements. First, we should enhance the political position, and develop an in-depth understanding of the significance of setting up the special trial teams and strengthening special trial work. We should enhance the sense of responsibility and mission, earnestly perform trial duties, apply law consistently, establish trial rules and guide the value of the society through special trial work. Second, we should clarify the target tasks and make active response to the needs of intellectual property judicial protection. We should implement the judicial policy of “judicial leadership, strict protection, classified application of policy, and proportional coordination”, adhere to the principles of “equal protection according to law, balance of interests, efficiency and convenience, openness and transparency”, and increase judicial protection of intellectual property rights. Third, we should improve work mechanisms and strengthen internal and external coordination and linkage. We should further rationalize the operation mode of special trial teams, give full play to the role of supervision and guidance of second instance, unify judicial standards, strengthen communication and coordination with competent departments of the free trade zone and the CIIE as well as the administrative departments of intellectual property, industry and commerce, and copyright, etc. to form a combined force. Fourth, we should focus on special investigation and strengthen forward-looking research of difficult problems and trial experience summary. We should carefully analyze and study the new situations and problems arising in the trials of the free trade zone and the CIIE, and build awareness of quality, in an attempt to create judicial protection experience that can be replicated and promoted. Fifth, we should increase publicity to give play to the regulatory and guidance role of justice. We should increase the publicity of typical cases, and make full use of judge studios, trial white papers, judicial proposals, etc. to serve and protect the creation and innovation of a law-based environmen
