Seminar on Sci-tech Innovation and Judicial Protection of TradeSecrets in Shanghai

November 28 witnessed the holding of the "Seminar on Sci-tech Innovation and Judicial Protection of Trade Secrets ", hosted by Technological Innovation Research Base of the Supreme People's Court for Intellectual Property Judicial Protection (Shanghai) and Shanghai Law Society, and co-organized by the Shanghai Intellectual Property Court (hereinafter referred to as SIPC) and Shanghai International College of Intellectual Property of Tongji University. More than 80 people attended the seminar, including leaders like Lin Guanghai, Vice President of the Intellectual Property Division of the Supreme People's Court, Zhang Bin, Vice President of Shanghai High People's Court, Shi Weidong, Full-time Vice President of Shanghai Law Society, Wu Jiang, Executive Vice President of Tongji University, Chen Yajuan, President of SIPC, and Li Shulan, Vice President of SIPC. Besides, more than 80 people including experts from Shanghai Municipal Procuratorate, Shanghai Public Security Bureau, Shanghai Intellectual Property Rights Bureau and colleges & universities, as well as leaders and judge delegates from the Intellectual Property Division of the Supreme People's Court, some high courts and intermediate courtselsewhere in the country, Beijing Intellectual Property Court and Guangzhou Intellectual Property Court and grass-roots courts across the country.

At the seminar, the judges of the Intellectual Property Division of the Supreme People's Court introduced the content of the draft of judicial interpretation on the application of law in the trial of cases involving infringement of trade secrets. The guests conducted in-depth discussions on the key points and difficulties of the judicial interpretation related to the criminal protection of trade secrets. They exchanged experiences and ideas on the basic legal issues such as the constitutive elements of trade secrets, the distribution of proof burden in civil cases involvingtrade secret infringement disputes, the criminal protection of tradesecrets, and the legal liability for infringement of trade secrets, which provided practical samples and theoretical support for further improvement of legislation and judicial rules.

Vice President Lin Guanghaipointed out that in recent years, some countries and economies have been constantly reforming and improvingthe protection of tradesecrets through revision of laws,posing new challenges for the protection of Chinese tradesecrets. We need torealize that the protection of tradesecrets has become increasingly important because of theconnection with international trade. Besides, the lack of an international cooperation mechanism makes the protection of tradesecrets more complicated, the accelerating technology update and integration makes it more urgent, and the difference in exclusive rights makes it more challenging. We should provide more effective safeguardingfor scientific and technological innovation and more effective judicial protection for tradesecrets through practice exploration and theoretical study of judicial protection.

Vice President Zhang Binsaid in his speech that strengthening protection of intellectual properties, including trade secrets, is of great significance and plays an important supporting role in promoting the construction of "Five Centers" and "Four Brands" in Shanghai. SIPCis expected to actively adapt to the new changes in international and domestic situations and the new normal of our economic development, vigorouslyenhance the awarenessof responsibility and innovation, further implement the intellectual property strategy and the innovation-driven development strategy, realize the goal of building an international first-class intellectual property court, and set an excellent example of intellectual property rights protection up to international standard.

Shi Weidong, Full-time Vice President of Shanghai Law Society, and Wu Jiang, Executive Vice President of Tongji University, delivered speeches respectively. Chen Yajuan, President of SIPC, delivered a welcome speech and presided over the opening ceremony, and Li Shulan, Vice President of SIPC, made a summary to conclude theseminar.
