On the morning of December 13, Chen Yajuan, Member of the Party Leadership Group of Shanghai High People’s Court and President of Shanghai Intellectual Property Court (“SIPC”), led Vice President Li Shulan, Chen Huizhen, full-time member of the judicial committee and heads of various departments of SIPC to Zhangjiang High-tech Industrial Development Zone to carry out research and discussions on S&T innovation and intellectual property protection of private enterprises. Wu Qiang, full-time Deputy Director of Shanghai Municipal Office for Promoting the Construction of Science and Technology Innovation Center, Zhang Ling, Deputy Director-General of FTZ Zhangjiang Administration, and other people participated in the research, while representatives of eight enterprises in information technology, biomedicine and other fields participated in the discussion. At the meeting, enterprise representatives reflected the pains, obstacles and difficulties encountered in IPR protection during their enterprise development, and put forward suggestions from the perspectives of allocating the burden of proof in a scientific way, increasing compensation for infringement, shortening the trial period of cases, and strengthening the dissemination of typical cases and legal knowledge on intellectual property protection, etc. Judges present at the meeting answered and responded positively to the questions and suggestions raised by the representatives. Vice President Li Shulan introduced the work and judicial protection measures taken by Shanghai Intellectual Property Court since its establishment, and put forward some suggestions on strengthening the intellectual property protection in private enterprises from the angle of system, strategy and method. Deputy Director Wu Qiang extended gratitude to the court for organizing this discussion meeting and to enterprises for providing suggestions on the construction of science and technology innovation center. President Chen Yajuan appreciated the representatives of private enterprises for their questions, opinions and suggestions, and said that in the next step, the court will better safeguard the development of private economy from three aspects: (i) analyze the questions and suggestions collected at the discussion meeting timely, make improvements and communicate with the enterprises to ensure equal, strict and efficient judicial protection in a better way; (ii) give full play to the role of Office of Judge Chen Huizhen, National Adjudication Expert, and do a better job in rule of law propaganda, case dissemination and legal consulting, etc. to provide legal services for private enterprises more directly and effectively; and (iii) establish a long-term mechanism with the help of Shanghai Municipal Office for Promoting the Construction of Science and Technology Innovation Center, meanwhile carry out regular researches and discussion meetings to learn about the judicial needs of enterprises in intellectual property protection in a timely manner.
