Mock Court of Shanghai IP Court Held at Dajing High School

In order to further popularize legal education and raise awareness of the rule of law and intellectual property protection among middle school students, on the eve of the Fifth National Constitution Day and the 30th Shanghai Constitution Week, judges of Shanghai Intellectual Property Court visited middle schools for the first time to hold a special “moot court” activity. On the morning of November 30, Judge Yang Fuyu, Assistant Judge Zhu Yonghua and Assistant Judge Zhang Zongbin came to Dajing High School Affiliated to Shanghai International Studies University with their carefully selected and adapted materials on a case of design patent infringement, intending to instruct students in Class 8, Senior 2 to conduct a “moot court” activity. Before the event, Judge Yang Fuyu briefed the students on the situation of the case and the basic court proceedings, introduced the laws and regulations relating to design patent and legal issues involved in infringement comparison, fully mobilized students’ enthusiasm for participation, and guided them to prepare statements and pleadings. After full preparation, students played their roles earnestly in moot court, carried out heated debate around the focus of the dispute and went through the basic proceedings successfully. After the trial, the students actively expressed their views on legal issues involved in the case. Judge Yang Fuyu affirmed the students’ performance in “moot court,” advised some improvements in such processes as producing evidence, cross-examination and court debate, exchanged views with the students on legal issues involved in the case, and answered the students’ questions patiently. This “moot court” activity not only popularized intellectual property laws to the students, guided them to establish legal awareness, but also further enriched their extracurricular life, let them perceive the dignity of court and the fairness and justice of law, and further enhanced their awareness of abiding by the law, thus forming a good habit of learning, obeying and respecting the law.
