On the afternoon of March 11, Zhan Wei, Legal Director of Alibaba Group, and his team visited Shanghai Intellectual Property Court (SIPC). Chen Huizhen, a full-time member of SIPC’s Adjudgement Committee, Ling Song, Deputy Chief of SIPC’s No.1 Tribunal, Judge Wu Yingzhe and Judge Yang Fuyu attended the seminar. The visitors introduced the Group's intellectual property rights protection system which includes “online complaints, active prevention and control, offline anti-fraud campaign, and cooperation with rights holder", how the Group has been doing in protecting intellectual property rights, how to work under the “notice-delete”rule, and the new legal issues in the digital age. They also introduced new judicial cases regarding unfair competition for big data products, click farming, and violation of evaluation data. Chen Huizhen affirmed and appreciated Alibaba Group's efforts in the use of cutting-edge technology, research on legal issues, and promotion of intellectual property rights protection through a dedicated platform. She also briefed the guests on the trial work of SIPC. The two sides also discussed the difficult legal issues occurring in the governance of e-commerce platforms, such as the burden of proof for linked service providers, malicious complaints, fraudulent data transactions and the application of the “notice-delete” rule. Both sides expressed the hope to strengthen the study of new legal issues in the digital age and jointly promote the development and improvement of statutory rules concerning intellectual property rights.
