On the morning of April 22, Shanghai Higher People’s Court held a press conference to announce the judicial protection of intellectual property rights of Shanghai courts in 2018. At the press conference, Li Shulan, Vice President of Shanghai Intellectual Property Court (“SIPC”), released Shanghai Intellectual Property Court’s Achievements in IP Protection (2018). This is the fourth consecutive year that SIPC issued an annual judicial white paper since its inception. The white paper, which is written in Chinese and English, presents the concreteachievementsof SIPC’s judicial protection of intellectual property rights in 2018. It reveals that SIPC, focusing on the implementation of national strategies and the construction of the “five centers” in Shanghai, especially the general plans of building the science and technology center, the free trade pilot zone and the import fair, etc., has duly performed the judicial function and played a leading role in judicial protection of intellectual property rights. In 2018, SIPC accepted 2,067 IP-related cases, up 1.82% from 2017, and concluded 2,067 cases of various types, up 1.77% from 2017. According to the white paper, SIPC has taken judicial measures to strengthen judicial protection of intellectual property rights, fully reflected the market value of intellectual property rights, strictly punished serious infringements, supported rights holders’ expenditure on rights protection in accordance with the law, strengthened the procedural guarantee of the realization of rights, given full play to the role of mediation before and during litigation, applied in accordance with the law the system of advance adjudication, improved the technical fact-finding mechanism and adopted information technology such as the Internet trial, in order to improve the convenience, transparency and satisfaction of dispute resolution over intellectual property rights.
