On the morning of April 24, 2019, at Shanghai Science Hall, Shanghai Intellectual Property Court (“SIPC”) and Shanghai Association for Science and Technology (SAST) jointly organized a briefing on the trial of intellectual property cases related to scientific and technological innovation and a symposium on the protection of intellectual property rights of sci-tech companies and sci-tech workers. Party Secretary and Vice President Ma Xingfa, Vice President Li Hongming of SAST, President Chen Yajuan, Vice President Li Shulan, Adjudgement Committee member Chen Huizhen of SIPC, and the heads of relevant departments of the two sides participated in the symposium. Other participants include 20 sci-tech workers and representatives from sci-tech organizations such as Huaqin Telecom, Microsoft, Kaiser Bio, Wolwo Biotech, Everdisplay Optronics, Shanghai Jiaotong University, and Shanghai Research and Development Public Service Platform. SIPC informed the trial of patent cases and computer software copyright cases, as well as the typical cases in 2017 and 2018, and talked with representatives from sci-tech companies and sci-tech workers. Representatives from sci-tech companies and sci-tech workers shared the intellectual property protection issues they had encountered in the process of innovation and entrepreneurship, and believed that the briefing and typical cases given by SIPC would help them raise awareness in legal protection of intellectual property rights, contract performance awareness and risk prevention, and enhance their confidence in protecting innovation results. Mr. Ma Xingfa said that serving sci-tech companies and sci-tech workers is the purpose of SAST, and strengthening the protection of scientific and technological innovation results is an important part of the service. With the abundant judicial practices and cases, SIPC has given the sci-tech companies and sci-tech workers an impressive lecture, which would help them a lot in creating, protecting and applying intellectual property rights. SAST will strengthen its cooperation with SIPC, and make good use of the brand projects such as judicial identification regarding intellectual property rights, academician and expert workstation, the “mass entrepreneurship and innovation” technology information services, the sci-tech professional title services, and legal consulting services, thereby providing more accurate services and stronger support for the development of sci-tech enterprises and the cultivation of sci-fi professionals. President Chen Yajuan said that listening to the opinions and suggestions of sci-tech companies and sci-tech workers and promoting legal protection of intellectual property rights is an important measure for SIPC to serve and guarantee the overall situation based on its judicial functions. SIPC will always adhere to the principle of fair justice and justice for the people, act by the principle of strict protection and equal protection, and make greater efforts to help rights holders solve the problems including “the difficulties to get evidence of infringement, the long period to get protection for patent, and the low remedies awarded.” It will give full play to the platforms of SIPC “Judge Chen Huizhen’s Studio” and “Judge Ling Song’s Studio,” get closer to the frontline of scientific and technological innovation to listen to the opinions and suggestions of sci-tech workers, thereby creating a fair, stable and transparent legal environment for scientific and technological innovation and business environment.
