SIPC Pronounced Judgement on 12 Cases to Highlightthe Effect of IP Rights Protection

As the 19th World Intellectual Property Day was approaching, on April 25, Shanghai Intellectual Property Court (“SIPC”) pronounced judgment on 12 intellectual property cases over patents and trademarks rights. The parties involved include Hoffmann-LaRoche, Alibaba, Louis Vuitton-Mariti, Paris Baguette, Red Star Macalline and other domestic and foreign well-known brands or enterprises. The purpose of this collective judgment is to strengthen the judicial protection of intellectual property rights, and highlight the functional role of IP-related trials in serving and guaranteeing scientific and technological innovation and in optimizing the business environment. This collective adjudgment reflects three characteristics: one, equal protection of Chinese and foreign parties. The winning parties include both well-known multinational enterprises and domestic ones. Two, huge compensation for infringement.For example, in the Tanwan Games vs. CloudToad Network Technology Co. case over infringement of trademark rights and unfair competition, the compensation amount reaches RMB 3 million. Three, effective protection of technical results. In the trial of several patent cases, thanks to the participation of technical experts or technical investigators, a fair judgment has been made based on identification of the technical facts involved in the case.
