Professor Kong Xiangjun’s Shared Thoughts on the Protection and Regulation of Competition Law on Data Rights at Shanghai IP court Academy

 

Shanghai Intellectual Property Court recently held the fourth lecture of Shanghai IP Court Academy. Kong Xiangjun, Dean, Chair Professor and Doctoral Tutor of Koguan School of Law of Shanghai Jiao Tong University, expounded on the protection of data rights from four aspects, i.e. legal construction of data rights, anti-unfair competition protection of data rights, legitimacy of data rights protection, and regulations on data monopoly in his lecture titled “Protection and Regulation of Competition Law on Data Rights”. Looking back on the evolution of legal protection from “privacy, personal information to data rights”, and illustrating with legislation dynamics and judicial cases related to data rights protection in recent years, the lecture combined theories and practices, having a great significance for guiding future trials. Ms. Li Shulan, Vice President of Shanghai Intellectual Property Court presided over and Chen Huizhen, a full-time member of the Judicial Committee, attended the lecture. All police officers of Shanghai Intellectual Property Court and some police officers of Shanghai No.3 Intermediate People’s Court listened to the lecture on the spot, while police officers of intellectual property tribunals of courts of Pudong New Area, Xuhui District, Yangpu District, and Putuo District attended the lecture via video link.
