








On the morning of August 23, Huang Rong, Vice
Chairman of All-China Federation of Industry and Commerce (ACFIC), led a
delegation to Shanghai Intellectual Property Court for investigating the status
quo of intellectual property right protection in private enterprises, accompanied
by Wang Zhixiong, Vice Chairman of ACFIC, Vice Chairman of Shanghai CPPCC and
Chairman of Shanghai Federation of Industry and Commerce, Wang Chuang, Deputy
Chief Judge of the No.3 Civil Tribunal of the Supreme People's Court, etc. Mao
Ronghua, the Party member and Vice President of Shanghai High People's Court,
and the persons-in-charge of relevant departments participated in the
investigation. Vice Chairman Huang Rong and his delegation visited the lawsuit
service center, the tribunals and other places of Shanghai Intellectual
Property Court, and attended an informal discussion on the work of intellectual
property right protection. Wang Qiuliang, President of Shanghai Intellectual
Property Court, introduced the trial works, judicial reform and other issues
since the establishment of Shanghai Intellectual Property Court, focusing on
the initiatives serving the overall interests and the professional trial
mechanism reform. Mao Ronghua, Vice President of Shanghai High People's Court, presided
over the discussion, and introduced the work effectiveness of the "1+1+6"
IPR trial pattern, "three-in-one" trial mode, serving the overall
interests, external exchange and other aspects. Vice Chairman Huang Rong fully
affirmed the works of Shanghai Intellectual Property Court since its
establishment, and introduced the background and theme of this investigation.
He pointed out that there were problems in case filing, difficulties in
providing evidence and low compensation in IPR protection as reflected by
private enterprises, and that the court also faced numerous challenges in the
trial. So he hoped that suggestions might be provided by Shanghai courts during
the investigation. Fully affirming the achievements of Shanghai Intellectual
Property Court since its establishment, Vice Chairman Wang Zhixiong indicated
that the private enterprises were faced with problems in litigation when
involved in intellectual property right disputes, and suggested that the courts
intensify their trial and law enforcement efforts, lift up their professional
and international levels, and improve the mechanism of connecting litigation with
mediation. The attendees discussed thoroughly and exchanged opinions about the
abovementioned issues. Speeches were delivered for the purpose of exchange by Deputy
