Copyright Law Enforcement Inspection Group of NPC standing Committee Conducted Law Enforcement Inspections in Shanghai Intellectual Property Court
 

On the morning of June 19, Member of the NPC StandingCommittee and Director of NPC Education, Science, Culture and Public Health Committee, Liu Binjie,Member of the NPC Standing Committee and Deputy Director of NPCEducation, Science, Culture and Public Health Committee, Liu Zhenqi, and Deputy Director of NPCEducation, Science, Culture and Public Health Committee, Li Chenjun, led the law enforcement inspection group to inspect the copyright law enforcement by Shanghai Intellectual Property Court and convened a seminar on judicial protection of copyrights. Deputy Director of the Standing Committee of Shanghai Municipal People's Congress, Xue Chao, Member of the Standing Committee of Shanghai Municipal People's Congress and Director of its Education, Science, Culture and Public Health Committee, Chen Kehong, Member of the Standing Committee of Shanghai Municipal People's Congress and Deputy Director of its Education, Science, Culture and Public Health Committee, Zhang Chen, Member of the Party Leadership Group and Vice President of Shanghai High People's Court, Mao Ronghua, and other leaders accompanied the inspection. Leaders of NPC Education, Science, Culture and Public Health Committee, State Administration of Press, Publication, Radio, Film and Television (SAPPRFT), Chinese Academy of Press and Publication, Education, Science, Culture and Public Health Committee of Shanghai Municipal People's Congress, as well as NPC deputies, experts, scholars, lawyers, and judge representatives of Shanghai Tier-3 courts attended the seminar. Director Chen Kehong presided over the seminar.

The inspection group visited the litigation service center and tribunals, and fully affirmed initiatives taken by Shanghai Intellectual Property Court to conduct pre-litigation mediation and improve the trial efficiency by means of information technology. President of Shanghai Intellectual Property Court, Wang Qiuliang,reported on the court's judicial protection of copyrights, while representatives of judges, scholars and lawyers delivered speeches respectively and exchanged views with the inspection group members.

Director Liu Binjie affirmed the exploration and practice of Shanghai Intellectual Property Court over the past two years, saying that intellectual property court is a new pilot court which has to do a lot of work to get into operation quickly under imperfect conditions. This inspection aims to promote the enforcement ofcopyright law, find out deficiencies and explore to establish a new intellectual property protection system. It's hoped that Shanghai Intellectual Property Court will step up the pilot work according to the central government's arrangement, and explore an IPR judicial protection system with Chinese characteristics on the basis of summing up the working experience. Director Liu Binjie stressed that at present, there're prominent problems in copyright-related judicial practice, such as difficulty in adjudication and compensation. Shanghai courts have accumulated much experience and studies some problems on IPR protection, especially copyright protection. The discussion among scholars and lawyers is also very meaningful. We should conscientiously sum up these experiences and further explore and improve the IPR judicial protection system. NPCEducation, Science, Culture and Public Health Committee will draw on your suggestions, opinions and practical experience to expedite the revision of the Copyright Law, thereby providing legal support for national innovation and serving the construction of an innovative country.
