Patent Right Disputes of Hu vs.Mobike (Beijing) Information Technology Tried at First Instance

On the morning of August 16, Shanghai Intellectual Property Court (SIPC) tried for public hearingthe case concerning disputes of patent right infringement between Hu, the Plaintiff, and Mobike (Beijing) Information Technology Co., Ltd. (hereinafter referred to as Mobike), the Defendant. SIPC conducted an open trial of the case according to the provisions of the Civil Procedure Law, with Wang Qiuliang, President of SIPC, acting as the Chief Judge in a 5-person collegial panel of “4+1”including Li Shulan (member of the Trial Committee), Chen Huizhen (member of the Trial Committee), Judge Shang Jiangang and People’s Juror Hu Bo. Technical Investigator Zhou Tao attended the trail. This marked the first time of SIPC to adopt a 5-person collegial panel in its trials. Procurators of both the Plaintiff and the Defendant were commissioned to participate in court litigations. During the trial, both parties expressed their views on the involved patent right requirements of “a type of electric vehicle control system and its operation” and the comparison of the technical features of the lockup control system of the alleged Mobike. Also they displayed on site the unlocking process of the alleged infringing product. Although facts of the technical disputes involved in the case were rather complicated, the trial was concluded within only one and a half hours through the adoption of a combined trial means of court investigation and court debates, which was concise and efficient. Tingshen.court.gov.cn and the Legal Channel of Shanghai Television broadcast the whole process of the trial which was also attended by many news journalists. Verdict will be given someday after review of the collegial panel.
