In order to deepen pharmaceutical companies’ understanding and application of patent law and raise their awareness of risk control concerning infringement, on January 30, Judge Chen Huizhen’s Studio invited representatives of bio-pharmaceutical companies in Zhangjiang Hi-Tech Park to audit the trial of a dispute over invention patent infringement (Astellas Pharma Inc. and Medivation, Inc. v. Shanghai Suntech Pharmaceutical Co. Ltd and Guilin Pharmaceutical (Shanghai) Co., Ltd.). Over 20 representatives of companies including Shanghai Pharmaceutical Holding Co., Ltd. and Shanghai Biochip Co.,Ltd. participated in the audit. Judge Chen Huizhen, a full-time member of our court’s judicial committee, acted as the presiding judge in the trial. The case involved infringement upon pharmaceutical patent. During the trial, the parties fully expressed their opinions on whether the behavior constitutes patent infringement and whether statutory exemption applies to the patent infringement. The trial went tightly and solemnly. This audit gave the companies in the park a clearer picture of pharmaceutical patent litigation and a better understanding of how to discover evidence, claim for rights and make defenses in pharmaceutical patent litigation.
