Judge of Shanghai Intellectual Property Court Was Invited to Attend the US-China Entertainment Law Conference

 

On 19 June, Hu Mi, a judge of No.1 Intellectual Property Division of Shanghai Intellectual Property Court, was invited to attend the Third Annual US-China Entertainment Law Conference. Held in Shanghai, this conference was jointly organized by the United States Patent and Trademark Office, Loyola Law School Los Angeles, KoGuan School of Law of Shanghai Jiao Tong University, Law School of Peking University, Beijing Film Academy and Shanghai Film (Group) Corporation, attended by Chinese and American government officials, senior judges, eminent scholars and lawyers totaling hundreds of people who had in-depth discussions on relevant legal issues in the cultural and entertainment industry. Judge Hu Mi, as a special guest, delivered a keynote speech on "trial practice of cases concerning online game disputes".She introduced how the overall scene of an online game constitutes assimilated works expressed by a process analogous to cinematography, whether the interactive operation of players affects the nature of cinematographic works, whether the protection of overall game scene affects the protection of a game material that can independently constitute a piece of work, the comparison methods of game scenes and other tricky problems involved in online game cases. She also summarized the issues that called forattention when handling such kind of cases and exchanged views with the participants, enhancing the understanding of such issues by relevant personnel and demonstrating the high-level expertise of Shanghai Intellectual Property Court in hearing intellectual property cases.
